Terms and Conditions

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

1. Cooling-off period: the period within which the consumer can exercise their right of withdrawal;
2. Consumer: the natural person who is not acting in the exercise of a profession or business and enters into a distance contract with the entrepreneur;
3. Day: calendar day;
4. Duration transaction: a distance contract regarding a series of products and/or services, for which the delivery and/or purchase obligation is spread over time;
5. Durable medium: any tool that enables the consumer or entrepreneur to store information addressed to them personally in a way that allows future consultation and unchanged reproduction of the stored information;
6. Right of withdrawal: the option for the consumer to waive the distance contract within the cooling-off period;
7. Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance (Cheapassbikes.nl);
8. Distance contract: a contract where, in the context of a system organized by the entrepreneur for the distance sale of products and/or services, up to and including the conclusion of the contract, exclusive use is made of one or more techniques for distance communication;
9. Technique for distance communication: a means that can be used for concluding a contract, without the consumer and entrepreneur having come together in the same room at the same time;
10. General Terms and Conditions: the present General Terms and Conditions of the entrepreneur.

Article 2 – Identity of the entrepreneur

Article 3 – Applicability

1. These general terms and conditions apply to every offer from the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.
2. Before the distance contract is concluded, the text of these general terms and conditions is made available to the consumer. If this is not reasonably possible, it will be indicated before the distance contract is concluded that the general terms and conditions can be viewed at the entrepreneur’s premises and will be sent free of charge as soon as possible at the consumer's request.
3. If the distance contract is concluded electronically, in deviation from the previous paragraph and before the distance contract is concluded, the text of these general terms and conditions can be made available to the consumer electronically in such a way that it can be easily stored by the consumer on a durable medium.
4. In the event that specific product or service conditions apply in addition to these general terms and conditions, the second and third paragraphs apply accordingly and the consumer can always invoke the applicable provision that is most favorable to them in the event of conflicting general terms and conditions.

Article 4 – The offer

1. If an offer has a limited period of validity or is made under conditions, this will be explicitly stated in the offer.
2. The offer is without obligation. The entrepreneur is entitled to change and adjust the offer.
3. The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to enable a proper assessment of the offer by the consumer.
4. Because Cheapassbikes sells unique, refurbished second-hand bicycles, each unit has been individually inspected, made 100% roadworthy technically, and provided with theft prevention registration. Bicycles may show light cosmetic traces of use or have been touched up with paint as part of the refurbishment process. Obvious mistakes or errors in the offer do not bind the entrepreneur.
5. Every offer contains clear information regarding the price (including taxes), any shipping costs, and the method of delivery.

Article 5 – The agreement

1. The agreement is concluded at the moment of acceptance by the consumer of the offer and compliance with the conditions set therein.
2. If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm receipt of the acceptance of the offer electronically. As long as receipt of this acceptance has not been confirmed by the entrepreneur, the consumer can rescind the agreement.
3. The entrepreneur takes appropriate technical and organizational measures to secure the electronic transfer of data and ensures a safe web environment for electronic payments.
4. Every agreement is entered into under the suspensive condition of sufficient availability of the relevant unique products.

Article 6 – Right of withdrawal

1. Upon the purchase of products, the consumer has the option to terminate the agreement without giving any reason for 14 days. This cooling-off period starts on the day after the product is received by the consumer or a previously designated representative.
2. During the cooling-off period, the consumer will handle the product and packaging with care. The consumer will only unpack or use the bicycle to the extent necessary to assess whether they wish to keep the bicycle (similar to a short test ride in a physical store).
3. If the consumer wishes to exercise their right of withdrawal, they are obliged to make this known to the entrepreneur within 14 days of receipt via email (info@cheapassbikes.nl) or WhatsApp, stating the order number.
4. After this notification, the consumer must arrange for the return or return the bicycle within 14 days in accordance with the entrepreneur's instructions.

Article 7 – Costs in case of withdrawal

1. If the consumer exercises their right of withdrawal, the direct costs of returning the product are for the consumer's account.
2. For the collection of a returned bicycle by our transport service, the transport costs are €45 in the Netherlands (€65 in Belgium; cargo bikes €149). If the consumer wishes to exchange the bicycle for another model from our range, the exchange costs are €25 (€40 in Belgium) instead of the full transport costs.
3. If the consumer returns the bicycle to our showroom in Rotterdam (Noorderhagen 229) in person, a 50% discount on the return costs applies.
4. If the consumer has already made a payment, the entrepreneur will refund this amount minus the applicable transport costs as soon as possible, but no later than 14 days after termination, via the same payment method, provided the bicycle has been received in good order.

Article 8 – Exclusion of the right of withdrawal

1. The entrepreneur can exclude the consumer's right of withdrawal for products that have been created according to specific instructions of the consumer (customization) or that are clearly personal in nature.
2. Exclusion of the right of withdrawal only applies if the entrepreneur has clearly stated this in the offer, at least in good time before the conclusion of the agreement.

Article 9 – The price

1. During the validity period mentioned in the offer, the prices of the products and/or services offered will not be increased, except for price changes resulting from changes in VAT rates or statutory provisions.
2. All stated prices include VAT. The legal margin scheme applies to our second-hand and refurbished bicycles (0% VAT on the invoice); the standard 21% VAT rate applies to new accessories and parts.
3. All prices are subject to obvious printing and typographical errors. In the event of obvious errors, the entrepreneur is not obliged to deliver the product at the incorrect price.

Article 10 – Conformity and warranty

1. The entrepreneur guarantees that the products comply with the agreement, the specifications stated in the offer, reasonable requirements of soundness and usability, and existing legal provisions.
2. Cheapassbikes provides a standard warranty period of 30 days (1 month) on all rotating and moving parts for all refurbished second-hand bicycles.
3. Should a technical defect occur within the warranty period, the consumer must report this immediately via email or WhatsApp. If the repair costs are less than €50, the repair can be carried out at a local bicycle shop in consultation and reimbursed by the entrepreneur. For repair costs exceeding €50, the entrepreneur will repair the defect free of charge in their own workshop.
4. The warranty is void if the defect is caused by normal wear and tear of consumable parts (such as tires and brake pads after intensive use), accident, negligent maintenance, or improper modifications by the consumer or third parties.

Article 11 – Delivery and execution

1. The entrepreneur will take the greatest possible care when receiving and executing orders.
2. The place of delivery is the address that the consumer has made known to the entrepreneur. Home delivery is free in the Netherlands (Belgium: €19.95).
3. Orders are delivered with due haste and no later than 30 days, usually within 1 to 2 working days after purchase.
4. If the consumer has ordered a bicycle lock and is not home at the time of delivery, the bicycle will be safely locked at the specified address and the bicycle keys will be left safely in the mailbox.
5. The risk of damage and/or loss of products remains with the entrepreneur until the moment of delivery to the consumer, unless explicitly agreed otherwise.

Article 12 – Duration transactions: duration, termination and renewal

Insofar as applicable to agreements for a definite or indefinite period, the legal rules regarding termination apply with a notice period of a maximum of one month in accordance with Dutch consumer law.

Article 13 – Payment

1. Unless otherwise agreed, the amounts owed by the consumer must be paid immediately upon placing the order via the offered secure online payment methods (such as iDEAL, Bancontact, credit card).
2. In principle, Cheapassbikes does not offer delayed payment or payment in installments via predatory credit schemes, to protect consumers against high late payment interest rates.
3. The consumer has the duty to report inaccuracies in provided payment details to the entrepreneur immediately.

Article 14 – Complaints procedure

1. The entrepreneur has a complaints procedure in place and handles complaints in accordance with this procedure.
2. Complaints about the performance of the agreement must be submitted fully and clearly described via info@cheapassbikes.nl within 1 month after the consumer has discovered the defects.
3. Complaints submitted to the entrepreneur will be answered within a period of 14 days from the date of receipt.
4. If the complaint cannot be resolved by mutual agreement, the consumer can turn to Stichting WebwinkelKeur (www.webwinkelkeur.nl) for free mediation. If this does not lead to a solution, the dispute can be submitted to the independent disputes committee of WebwinkelKeur or the European ODR platform (ec.europa.eu/consumers/odr).

Article 15 – Disputes

1. Dutch law exclusively applies to agreements between the entrepreneur and the consumer to which these general terms and conditions relate, even if the consumer resides abroad.
2. The applicability of the Vienna Sales Convention (CISG) is explicitly excluded. Any disputes will be exclusively submitted to the competent Dutch court in the district of Rotterdam.

Article 16 – Additional or deviating provisions

Additional provisions or provisions that deviate from these general terms and conditions may not be to the detriment of the consumer and must be recorded in writing or in such a way that they can be stored by the consumer in an accessible manner on a durable medium.

Article 1 – Definitions

1. Cooling-off period: the period within which the consumer can exercise their right of withdrawal;
2. Consumer: the natural person who is not acting in the exercise of a profession or business and enters into a distance contract with the trader;

4. Extended duration transaction: a distance contract relating to a series of products and/or services whose delivery and/or purchase obligation is spread over time;
5. Durable medium: any tool that enables the consumer or trader to store information addressed personally to them in a way that allows future consultation and unchanged reproduction;
6. Right of withdrawal: the possibility for the consumer to dissolve the distance contract within the cooling-off period;
7. Trader: the natural or legal person who offers products and/or services to consumers at a distance (Cheapassbikes.nl);
8. Distance contract: an agreement concluded under an organized distance sales scheme, using exclusively one or more distance communication techniques up to the conclusion of the contract;
9. Distance communication technique: means used for concluding a contract without the consumer and trader being simultaneously present in the same room;
10. Terms of Service: these general terms and conditions of the trader.

Article 2 – Identity of the Trader

Article 3 – Applicability

1. These general terms and conditions apply to every offer made by the trader and to every distance contract and order concluded between the trader and consumer.
2. Before the distance contract is concluded, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the contract is concluded that the terms can be inspected at the trader's premises and will be sent free of charge upon request.
3. If the distance contract is concluded electronically, the text of these terms and conditions can be made available to the consumer electronically in such a way that it can be easily stored on a durable medium.

Article 4 – The Offer

1. If an offer has a limited validity period or is subject to conditions, this will be explicitly stated.
2. The offer contains a complete and accurate description of the products offered. Because Cheapassbikes sells unique refurbished second-hand bicycles, each bicycle is individually inspected, 100% technically restored to roadworthiness, and registered against theft. Bicycles may display minor cosmetic signs of use or paint touch-ups resulting from the refurbishing process.
3. Obvious mistakes or typographical errors in the offer do not bind the trader.
4. Each offer contains clear details regarding pricing (including applicable taxes) and shipping options.

Article 5 – The Agreement

1. The contract is concluded at the moment the consumer accepts the offer and complies with the corresponding conditions.
2. If the consumer has accepted the offer electronically, the trader will immediately confirm receipt of acceptance electronically. Until receipt of this acceptance is confirmed, the consumer may dissolve the contract.
3. The trader takes appropriate technical and organizational measures to secure electronic data transfers and provides a secure web environment for online payments.
4. Every contract is entered into subject to the suspensive condition of sufficient availability of the unique refurbished item.

Article 6 – Right of Withdrawal

1. When purchasing products, the consumer has the option to dissolve the contract without giving reasons within 14 days. This cooling-off period commences on the day after receipt of the product by the consumer or their designated representative.
2. During the cooling-off period, the consumer shall handle the product and packaging with care, only unpacking and testing the bicycle to the extent necessary to evaluate whether they wish to keep it.
3. To exercise the right of withdrawal, the consumer must notify the trader within 14 days via email (info@cheapassbikes.nl) or WhatsApp, stating the order number.
4. Following this notification, the bicycle must be returned within 14 days in accordance with the return instructions provided.

Article 7 – Costs in Case of Withdrawal

1. If the consumer exercises their right of withdrawal, the direct costs of returning the product are borne by the consumer.
2. For collection via our dedicated transport service, return shipping costs are €45 in the Netherlands (€65 in Belgium; cargo bikes €149). If the consumer wishes to exchange the bike for another model, the exchange fee is €25 (€40 in Belgium).
3. If the consumer returns the bicycle in person to our Rotterdam showroom (Noorderhagen 229), a 50% discount applies to return handling fees.
4. The trader will refund the purchase amount minus applicable return shipping fees within 14 days of withdrawal, provided the bike has been received in good order.

Article 8 – Exclusion of the Right of Withdrawal

1. The trader may exclude the right of withdrawal for goods made to the consumer’s specifications or clearly personalized in nature.
2. Any exclusion applies only if clearly communicated prior to concluding the agreement.

Article 9 – The Price

1. During the validity period stated in the offer, product prices will not be increased, except for changes resulting from statutory VAT regulations.
2. All prices include VAT. Refurbished second-hand bicycles are sold under the statutory VAT margin scheme (0% VAT indicated on invoice); new accessories and components include 21% VAT.
3. Prices are subject to evident typographical errors; the trader is not obligated to supply goods at misquoted erroneous prices.

Article 10 – Conformity and Warranty

1. The trader guarantees that the products comply with the agreement, the specifications stated in the offer, and reasonable requirements of sound usability.
2. Cheapassbikes provides a standard 30-day (1 month) warranty on all refurbished bicycles covering all moving and mechanical parts.
3. If a technical defect occurs within the warranty period, notify us immediately via email or WhatsApp. Repairs up to €50 can be carried out by a local bicycle mechanic and reimbursed by Cheapassbikes upon prior approval. Deficiencies exceeding €50 will be repaired free of charge at our central Rotterdam workshop.
4. The warranty does not cover normal wear and tear of consumable parts (e.g. tires and brake pads), accidents, improper maintenance, or unauthorized modifications.

Article 11 – Delivery and Execution

1. The trader will exercise the greatest care when receiving and dispatching orders. Delivery is free in the Netherlands (Belgium: €19.95).
2. The place of delivery is the address specified by the consumer. Orders are fulfilled within 30 days, usually within 1–2 business days.
3. If the customer ordered a lock and is not home at the time of delivery, the bicycle will be securely locked at the delivery address and the keys placed safely in the mailbox.
4. The risk of damage and/or loss remains with the trader until the moment of physical delivery to the consumer.

Article 12 – Extended Duration Transactions

Any fixed-term or indefinite agreements comply with statutory consumer protection regulations regarding cancellation notice periods (maximum 1 month).

Article 13 – Payment

1. Unless agreed otherwise, payments are due upon ordering via the secure payment gateways offered (iDEAL, Bancontact, credit card, etc.).
2. Cheapassbikes strictly rejects predatory post-pay credit providers that charge disproportionate penalty interest rates to consumers.
3. The consumer must report any payment data inaccuracies to the trader without delay.

Article 14 – Complaints Procedure

1. The trader maintains a clear complaints procedure and handles complaints in accordance with this scheme.
2. Complaints about the execution of the contract must be submitted with full details within 1 month of discovery to info@cheapassbikes.nl.
3. Complaints submitted will be answered within 14 days of receipt.
4. If a complaint cannot be resolved mutually, consumers may access free mediation via Stichting WebwinkelKeur (www.webwinkelkeur.nl), the WebwinkelKeur independent dispute committee, or the European ODR platform (ec.europa.eu/consumers/odr).

Article 15 – Disputes

1. Contracts between the trader and consumer governed by these terms are exclusively subject to Dutch law, even if the consumer resides abroad.
2. The Vienna Sales Convention (CISG) is expressly excluded. Disputes shall be submitted to the competent court in Rotterdam, The Netherlands.

Article 16 – Additional or Deviating Provisions

Additional or deviating provisions may not be to the consumer’s detriment and must be recorded in writing or in such a manner that they can be retained on a durable medium.
