Artikel 1 – Definities

In deze algemene voorwaarden wordt verstaan onder:

  1. Bedenktijd: de termijn waarbinnen de consument gebruik kan maken van zijn herroepingsrecht;
  2. Consument: de natuurlijke persoon die niet handelt in de uitoefening van beroep of bedrijf en een overeenkomst op afstand aangaat met de ondernemer;
  3. Dag: kalenderdag;
  4. Duurtransactie: een overeenkomst op afstand met betrekking tot een reeks van producten en/of diensten, waarvan de leverings- en/of afnameverplichting in de tijd is gespreid;
  5. Duurzame gegevensdrager: elk middel dat de consument of ondernemer in staat stelt om informatie die aan hem persoonlijk is gericht, op te slaan op een manier die toekomstige raadpleging en ongewijzigde reproductie van de opgeslagen informatie mogelijk maakt;
  6. Herroepingsrecht: de mogelijkheid voor de consument om binnen de bedenktijd af te zien van de overeenkomst op afstand;
  7. Ondernemer: de natuurlijke of rechtspersoon die producten en/of diensten op afstand aan consumenten aanbiedt (Cheapassbikes.nl);
  8. Overeenkomst op afstand: een overeenkomst waarbij in het kader van een door de ondernemer georganiseerd systeem voor verkoop op afstand van producten en/of diensten, tot en met het sluiten van de overeenkomst uitsluitend gebruik gemaakt wordt van één of meer technieken voor communicatie op afstand;
  9. Techniek voor communicatie op afstand: middel dat kan worden gebruikt voor het sluiten van een overeenkomst, zonder dat consument en ondernemer gelijktijdig in dezelfde ruimte zijn samengekomen;
  10. Algemene Voorwaarden: de onderhavige Algemene Voorwaarden van de ondernemer.

Artikel 3 – Toepasselijkheid

  1. Deze algemene voorwaarden zijn van toepassing op elk aanbod van de ondernemer en op elke tot stand gekomen overeenkomst op afstand en bestellingen tussen ondernemer en consument.
  2. Voordat de overeenkomst op afstand wordt gesloten, wordt de tekst van deze algemene voorwaarden aan de consument beschikbaar gesteld. Indien dit redelijkerwijs niet mogelijk is, zal voordat de overeenkomst op afstand wordt gesloten, worden aangegeven dat de algemene voorwaarden bij de ondernemer zijn in te zien en zij op verzoek van de consument zo spoedig mogelijk kosteloos worden toegezonden.
  3. Indien de overeenkomst op afstand elektronisch wordt gesloten, kan in afwijking van het vorige lid en voordat de overeenkomst op afstand wordt gesloten, de tekst van deze algemene voorwaarden langs elektronische weg aan de consument ter beschikking worden gesteld op zodanige wijze dat deze door de consument op een eenvoudige manier kan worden opgeslagen op een duurzame gegevensdrager.
  4. Voor het geval dat naast deze algemene voorwaarden tevens specifieke product- of dienstenvoorwaarden van toepassing zijn, is het tweede en derde lid van overeenkomstige toepassing en kan de consument zich in geval van tegenstrijdige algemene voorwaarden steeds beroepen op de toepasselijke bepaling die voor hem het meest gunstig is.

Artikel 4 – Het aanbod

  1. Indien een aanbod een beperkte geldigheidsduur heeft of onder voorwaarden geschiedt, wordt dit nadrukkelijk in het aanbod vermeld.
  2. Het aanbod is vrijblijvend. De ondernemer is gerechtigd het aanbod te wijzigen en aan te passen.
  3. Het aanbod bevat een volledige en nauwkeurige omschrijving van de aangeboden producten en/of diensten. De beschrijving is voldoende gedetailleerd om een goede beoordeling van het aanbod door de consument mogelijk te maken.
  4. Omdat Cheapassbikes unieke, refurbished tweedehands fietsen verkoopt, is elk exemplaar individueel nagelopen, technisch 100% rijklaar gemaakt en voorzien van diefstalpreventie-registratie. Fietsen kunnen lichte cosmetische gebruikssporen vertonen of bijgewerkt zijn met lak ten behoeve van het refurbishmentproces. Kennelijke vergissingen of fouten in het aanbod binden de ondernemer niet.
  5. Elk aanbod bevat duidelijke informatie over de prijs (inclusief belastingen), eventuele verzendkosten en de wijze van levering.

Artikel 5 – De overeenkomst

  1. De overeenkomst komt tot stand op het moment van aanvaarding door de consument van het aanbod en het voldoen aan de daarbij gestelde voorwaarden.
  2. Indien de consument het aanbod langs elektronische weg heeft aanvaard, bevestigt de ondernemer onverwijld langs elektronische weg de ontvangst van de aanvaarding van het aanbod. Zolang de ontvangst van deze aanvaarding niet door de ondernemer is bevestigd, kan de consument de overeenkomst ontbinden.
  3. De ondernemer treft passende technische en organisatorische maatregelen ter beveiliging van de elektronische overdracht van data en zorgt voor een veilige webomgeving voor elektronische betalingen.
  4. Iedere overeenkomst wordt aangegaan onder de opschortende voorwaarde van voldoende beschikbaarheid van de betreffende unieke producten.

Artikel 6 – Herroepingsrecht

  1. Bij de aankoop van producten heeft de consument de mogelijkheid de overeenkomst zonder opgave van redenen te ontbinden gedurende 14 dagen. Deze bedenktermijn gaat in op de dag na ontvangst van het product door de consument of een vooraf aangewezen vertegenwoordiger.
  2. Tijdens de bedenktijd zal de consument zorgvuldig omgaan met het product en de verpakking. De consument zal de fiets slechts uitpakken of gebruiken voor zover dat nodig is om te kunnen beoordelen of hij de fiets wenst te behouden (vergelijkbaar met een korte proefrit in een fysieke winkel).
  3. Wanneer de consument gebruik wenst te maken van zijn herroepingsrecht, is hij verplicht dit binnen 14 dagen na ontvangst kenbaar te maken aan de ondernemer via e-mail (info@cheapassbikes.nl) of WhatsApp, met vermelding van het ordernummer.
  4. Na deze melding dient de consument de retourzending af te stemmen of de fiets binnen 14 dagen te retourneren conform de instructies van de ondernemer.

Artikel 7 – Kosten in geval van herroeping

  1. Indien de consument gebruik maakt van zijn herroepingsrecht, komen de rechtstreekse kosten van de terugzending voor rekening van de consument.
  2. Voor het ophalen van een geretourneerde fiets door onze transportdienst bedragen de transportkosten €45,- in Nederland (€65,- in België; bakfietsen €149,-). Wenst de consument de fiets om te ruilen voor een ander model uit ons assortiment, dan bedragen de omruilkosten €25,- (€40,- in België) in plaats van de volledige transportkosten.
  3. Indien de consument de fiets zelf inlevert bij onze showroom in Rotterdam (Noorderhagen 229), geldt een korting van 50% op de retourkosten.
  4. Indien de consument reeds een betaling heeft voldaan, zal de ondernemer dit bedrag minus de toepasselijke transportkosten zo spoedig mogelijk, doch uiterlijk binnen 14 dagen na ontbinding, terugbetalen via dezelfde betaalmethode, mits de fiets in goede orde is ontvangen.

Artikel 8 – Uitsluiting herroepingsrecht

  1. De ondernemer kan het herroepingsrecht van de consument uitsluiten voor producten die tot stand zijn gebracht overeenkomstig specifieke instructies van de consument (maatwerk) of die duidelijk persoonlijk van aard zijn.
  2. Uitsluiting van het herroepingsrecht geldt slechts indien de ondernemer dit duidelijk in het aanbod, althans tijdig voor het sluiten van de overeenkomst, heeft vermeld.

Artikel 9 – De prijs

  1. Gedurende de in het aanbod vermelde geldigheidsduur worden de prijzen van de aangeboden producten en/of diensten niet verhoogd, behoudens prijswijzigingen als gevolg van veranderingen in btw-tarieven of wettelijke bepalingen.
  2. Alle genoemde prijzen zijn inclusief btw. Op onze tweedehands en refurbished fietsen is de wettelijke margeregeling van toepassing (0% btw op de factuur); op nieuwe accessoires en onderdelen is het standaard btw-tarief van 21% van toepassing.
  3. Alle prijzen zijn onder voorbehoud van kennelijke druk- en zetfouten. Bij evidente fouten is de ondernemer niet verplicht het product tegen de foutieve prijs te leveren.

Artikel 10 – Conformiteit en garantie

  1. De ondernemer staat er voor in dat de producten voldoen aan de overeenkomst, de in het aanbod vermelde specificaties, aan de redelijke eisen van deugdelijkheid en bruikbaarheid en de bestaande wettelijke bepalingen.
  2. Op alle refurbished tweedehands fietsen verleent Cheapassbikes een standaard garantietermijn van 30 dagen (1 maand) op alle draaiende en bewegende onderdelen.
  3. Mocht zich binnen de garantietermijn een technisch mankement voordoen, dan dient de consument dit direct te melden via e-mail of WhatsApp. Indien de herstelkosten minder dan €50,- bedragen, kan de reparatie in overleg bij een lokale fietsenmaker worden uitgevoerd en worden vergoed door de ondernemer. Bij herstelkosten boven €50,- repareert de ondernemer het defect kosteloos in de eigen werkplaats.
  4. De garantie vervalt indien het mankement is veroorzaakt door normale slijtage van verbruiksonderdelen (zoals banden en remblokjes na intensief gebruik), ongeval, nalatig onderhoud of onoordeelkundige modificaties door de consument of derden.

Artikel 11 – Levering en uitvoering

  1. De ondernemer neemt de grootst mogelijke zorgvuldigheid in acht bij het in ontvangst nemen en uitvoeren van bestellingen.
  2. Als plaats van levering geldt het adres dat de consument aan de ondernemer kenbaar heeft gemaakt. Thuisbezorging is gratis in Nederland (België: €19,95).
  3. Bestellingen worden met bekwame spoed en uiterlijk binnen 30 dagen geleverd, doorgaans binnen 1 tot 2 werkdagen na aankoop.
  4. Indien de consument een fietsslot heeft meebesteld en niet thuis is op het moment van aflevering, wordt de fiets veilig op slot gezet op het opgegeven adres en worden de fietssleutels veilig in de brievenbus achtergelaten.
  5. Het risico van beschadiging en/of vermissing van producten berust bij de ondernemer tot het moment van bezorging aan de consument, tenzij uitdrukkelijk anders is overeengekomen.

Artikel 12 – Duurtransacties: duur, opzegging en verlenging

Voor zover van toepassing op overeenkomsten voor bepaalde of onbepaalde tijd, gelden de wettelijke regels omtrent opzegging met een opzegtermijn van maximaal één maand conform het Nederlandse consumentenrecht.

Artikel 13 – Betaling

  1. Voor zover niet anders is overeengekomen, dienen de door de consument verschuldigde bedragen direct bij het plaatsen van de bestelling via de aangeboden veilige online betaalmethoden (zoals iDEAL, Bancontact, creditcard) te worden voldaan.
  2. Cheapassbikes biedt principieel geen achterafbetaling of betaling in termijnen aan via woekerkredieten, ter bescherming van consumenten tegen hoge vertragingsrentes.
  3. De consument heeft de plicht om onjuistheden in verstrekte betaalgegevens onverwijld aan de ondernemer te melden.

Artikel 14 – Klachtenregeling

  1. De ondernemer beschikt over een klachtenprocedure en behandelt klachten overeenkomstig deze procedure.
  2. Klachten over de uitvoering van de overeenkomst moeten binnen 1 maand nadat de consument de gebreken heeft geconstateerd, volledig en duidelijk omschreven worden ingediend via info@cheapassbikes.nl.
  3. Bij de ondernemer ingediende klachten worden binnen een termijn van 14 dagen gerekend vanaf de datum van ontvangst beantwoord.
  4. Indien de klacht niet in onderling overleg kan worden opgelost, kan de consument zich wenden tot Stichting WebwinkelKeur (www.webwinkelkeur.nl) voor gratis bemiddeling. Mocht dit niet tot een oplossing leiden, dan kan het geschil worden voorgelegd aan de onafhankelijke geschillencommissie van WebwinkelKeur of het Europees ODR-platform (ec.europa.eu/consumers/odr).

Artikel 15 – Geschillen

  1. Op overeenkomsten tussen de ondernemer en de consument waarop deze algemene voorwaarden betrekking hebben, is uitsluitend Nederlands recht van toepassing, ook indien de consument woonachtig is in het buitenland.
  2. De toepasselijkheid van het Weens Koopverdrag (CISG) is uitdrukkelijk uitgesloten. Eventuele geschillen worden bij uitsluiting voorgelegd aan de bevoegde Nederlandse rechter in het arrondissement Rotterdam.

Artikel 16 – Aanvullende of afwijkende bepalingen

Aanvullende dan wel van deze algemene voorwaarden afwijkende bepalingen mogen niet ten nadele van de consument zijn en dienen schriftelijk te worden vastgelegd dan wel op zodanige wijze dat deze door de consument op een toegankelijke manier kunnen worden opgeslagen op een duurzame gegevensdrager.

Article 1 – Definitions

In these general terms and conditions, the following terms shall have the following meanings:

  1. Cooling-off period: the period within which the consumer can exercise their right of withdrawal;
  2. Consumer: the natural person who is not acting in the exercise of a profession or business and enters into a distance contract with the trader;
  3. Day: calendar day;
  4. Extended duration transaction: a distance contract relating to a series of products and/or services whose delivery and/or purchase obligation is spread over time;
  5. Durable medium: any tool that enables the consumer or trader to store information addressed personally to them in a way that allows future consultation and unchanged reproduction;
  6. Right of withdrawal: the possibility for the consumer to dissolve the distance contract within the cooling-off period;
  7. Trader: the natural or legal person who offers products and/or services to consumers at a distance (Cheapassbikes.nl);
  8. Distance contract: an agreement concluded under an organized distance sales scheme, using exclusively one or more distance communication techniques up to the conclusion of the contract;
  9. Distance communication technique: means used for concluding a contract without the consumer and trader being simultaneously present in the same room;
  10. Terms of Service: these general terms and conditions of the trader.

Article 3 – Applicability

  1. These general terms and conditions apply to every offer made by the trader and to every distance contract and order concluded between the trader and consumer.
  2. Before the distance contract is concluded, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the contract is concluded that the terms can be inspected at the trader's premises and will be sent free of charge upon request.
  3. If the distance contract is concluded electronically, the text of these terms and conditions can be made available to the consumer electronically in such a way that it can be easily stored on a durable medium.

Article 4 – The Offer

  1. If an offer has a limited validity period or is subject to conditions, this will be explicitly stated.
  2. The offer contains a complete and accurate description of the products offered. Because Cheapassbikes sells unique refurbished second-hand bicycles, each bicycle is individually inspected, 100% technically restored to roadworthiness, and registered against theft. Bicycles may display minor cosmetic signs of use or paint touch-ups resulting from the refurbishing process.
  3. Obvious mistakes or typographical errors in the offer do not bind the trader.
  4. Each offer contains clear details regarding pricing (including applicable taxes) and shipping options.

Article 5 – The Agreement

  1. The contract is concluded at the moment the consumer accepts the offer and complies with the corresponding conditions.
  2. If the consumer has accepted the offer electronically, the trader will immediately confirm receipt of acceptance electronically. Until receipt of this acceptance is confirmed, the consumer may dissolve the contract.
  3. The trader takes appropriate technical and organizational measures to secure electronic data transfers and provides a secure web environment for online payments.
  4. Every contract is entered into subject to the suspensive condition of sufficient availability of the unique refurbished item.

Article 6 – Right of Withdrawal

  1. When purchasing products, the consumer has the option to dissolve the contract without giving reasons within 14 days. This cooling-off period commences on the day after receipt of the product by the consumer or their designated representative.
  2. During the cooling-off period, the consumer shall handle the product and packaging with care, only unpacking and testing the bicycle to the extent necessary to evaluate whether they wish to keep it.
  3. To exercise the right of withdrawal, the consumer must notify the trader within 14 days via email (info@cheapassbikes.nl) or WhatsApp, stating the order number.
  4. Following this notification, the bicycle must be returned within 14 days in accordance with the return instructions provided.

Article 7 – Costs in Case of Withdrawal

  1. If the consumer exercises their right of withdrawal, the direct costs of returning the product are borne by the consumer.
  2. For collection via our dedicated transport service, return shipping costs are €45 in the Netherlands (€65 in Belgium; cargo bikes €149). If the consumer wishes to exchange the bike for another model, the exchange fee is €25 (€40 in Belgium).
  3. If the consumer returns the bicycle in person to our Rotterdam showroom (Noorderhagen 229), a 50% discount applies to return handling fees.
  4. The trader will refund the purchase amount minus applicable return shipping fees within 14 days of withdrawal, provided the bike has been received in good order.

Article 8 – Exclusion of the Right of Withdrawal

  1. The trader may exclude the right of withdrawal for goods made to the consumer’s specifications or clearly personalized in nature.
  2. Any exclusion applies only if clearly communicated prior to concluding the agreement.

Article 9 – The Price

  1. During the validity period stated in the offer, product prices will not be increased, except for changes resulting from statutory VAT regulations.
  2. All prices include VAT. Refurbished second-hand bicycles are sold under the statutory VAT margin scheme (0% VAT indicated on invoice); new accessories and components include 21% VAT.
  3. Prices are subject to evident typographical errors; the trader is not obligated to supply goods at misquoted erroneous prices.

Article 10 – Conformity and Warranty

  1. The trader guarantees that the products comply with the agreement, the specifications stated in the offer, and reasonable requirements of sound usability.
  2. Cheapassbikes provides a standard 30-day (1 month) warranty on all refurbished bicycles covering all moving and mechanical parts.
  3. If a technical defect occurs within the warranty period, notify us immediately via email or WhatsApp. Repairs up to €50 can be carried out by a local bicycle mechanic and reimbursed by Cheapassbikes upon prior approval. Deficiencies exceeding €50 will be repaired free of charge at our central Rotterdam workshop.
  4. The warranty does not cover normal wear and tear of consumable parts (e.g. tires and brake pads), accidents, improper maintenance, or unauthorized modifications.

Article 11 – Delivery and Execution

  1. The trader will exercise the greatest care when receiving and dispatching orders. Delivery is free in the Netherlands (Belgium: €19.95).
  2. The place of delivery is the address specified by the consumer. Orders are fulfilled within 30 days, usually within 1–2 business days.
  3. If the customer ordered a lock and is not home at the time of delivery, the bicycle will be securely locked at the delivery address and the keys placed safely in the mailbox.
  4. The risk of damage and/or loss remains with the trader until the moment of physical delivery to the consumer.

Article 12 – Extended Duration Transactions

Any fixed-term or indefinite agreements comply with statutory consumer protection regulations regarding cancellation notice periods (maximum 1 month).

Article 13 – Payment

  1. Unless agreed otherwise, payments are due upon ordering via the secure payment gateways offered (iDEAL, Bancontact, credit card, etc.).
  2. Cheapassbikes strictly rejects predatory post-pay credit providers that charge disproportionate penalty interest rates to consumers.
  3. The consumer must report any payment data inaccuracies to the trader without delay.

Article 14 – Complaints Procedure

  1. The trader maintains a clear complaints procedure and handles complaints in accordance with this scheme.
  2. Complaints about the execution of the contract must be submitted with full details within 1 month of discovery to info@cheapassbikes.nl.
  3. Complaints submitted will be answered within 14 days of receipt.
  4. If a complaint cannot be resolved mutually, consumers may access free mediation via Stichting WebwinkelKeur (www.webwinkelkeur.nl), the WebwinkelKeur independent dispute committee, or the European ODR platform (ec.europa.eu/consumers/odr).

Article 15 – Disputes

  1. Contracts between the trader and consumer governed by these terms are exclusively subject to Dutch law, even if the consumer resides abroad.
  2. The Vienna Sales Convention (CISG) is expressly excluded. Disputes shall be submitted to the competent court in Rotterdam, The Netherlands.

Article 16 – Additional or Deviating Provisions

Additional or deviating provisions may not be to the consumer’s detriment and must be recorded in writing or in such a manner that they can be retained on a durable medium.

Article 1 – Définitions

Dans les présentes conditions générales de vente, les définitions suivantes s'appliquent :

  1. Délai de rétractation : la période pendant laquelle le consommateur peut exercer son droit de rétractation ;
  2. Consommateur : toute personne physique qui agit à des fins qui n'entrent pas dans le cadre de son activité commerciale, industrielle, artisanale ou libérale et qui conclut un contrat à distance avec l'entreprise ;
  3. Jour : jour calendaire ;
  4. Contrat à exécution successive : contrat à distance relatif à une série de produits ou de services dont l'obligation de livraison et/ou d'achat s'échelonne dans le temps ;
  5. Support durable : tout instrument permettant au consommateur ou au professionnel de stocker des informations qui lui sont adressées personnellement, d'une manière permettant de s'y reporter à l'avenir pendant une durée adaptée ;
  6. Droit de rétractation : faculté offerte au consommateur de renoncer au contrat à distance dans le délai de réflexion ;
  7. Entreprise / Professionnel : la personne morale ou physique proposant des biens et/ou services à distance aux consommateurs (Cheapassbikes.nl) ;
  8. Contrat à distance : contrat conclu entre l'entreprise et le consommateur dans le cadre d'un système de vente à distance de produits organisé par l'entreprise ;
  9. Technique de communication à distance : moyen utilisé pour la conclusion d'un contrat sans la présence physique simultanée du professionnel et du consommateur.

Article 3 – Champ d'application

  1. Les présentes conditions générales s'appliquent à toute offre émise par l'entreprise et à tout contrat à distance et toute commande passée entre l'entreprise et le consommateur.
  2. Le texte des présentes conditions générales est mis à la disposition du consommateur avant la conclusion du contrat à distance, notamment par voie électronique de façon à ce qu'il puisse le conserver sur un support durable.

Article 4 – L'offre

  1. Si une offre a une durée de validité limitée ou est soumise à des conditions particulières, mention expresse en est faite dans l'offre.
  2. L'offre contient une description complète et précise des produits proposés. Cheapassbikes commercialise des vélos d'occasion reconditionnés uniques : chaque bicyclette fait l'objet d'un contrôle technique rigoureux, est 100% en état de rouler et enregistrée contre le vol. Les vélos peuvent comporter de légères traces d'usure esthétique ou des retouches de peinture inhérentes au processus de reconditionnement.
  3. Les erreurs matérielles ou fautes manifestes d'impression dans l'offre ne lient pas l'entreprise.
  4. Chaque offre mentionne clairement le prix toutes taxes comprises et les modalités de livraison applicables.

Article 5 – Le contrat

  1. Le contrat est conclu au moment de l'acceptation de l'offre par le consommateur et de la satisfaction aux conditions requises.
  2. Si le consommateur a accepté l'offre par voie électronique, l'entreprise confirme immédiatement la réception de cette acceptation par e-mail.
  3. L'entreprise met en œuvre des mesures techniques appropriées pour sécuriser la transmission électronique des données et garantir un environnement de paiement en ligne sécurisé.
  4. Tout contrat est conclu sous la condition suspensive de la disponibilité effective de l'exemplaire reconditionné commandé.

Article 6 – Droit de rétractation

  1. Lors de l'achat d'un bien, le consommateur dispose d'un délai légal de 14 jours pour résilier le contrat sans indication de motif. Ce délai prend effet le lendemain de la réception du produit par le consommateur.
  2. Pendant ce délai, le consommateur manipule le produit avec précaution et ne le déballe ou l'utilise que dans la mesure requise pour évaluer ses caractéristiques et son bon fonctionnement.
  3. Le consommateur informe l'entreprise de son souhait de se rétracter dans les 14 jours suivant la réception par e-mail (info@cheapassbikes.nl) ou WhatsApp avec le numéro de commande.
  4. Le vélo doit être retourné sous 14 jours suivant cette notification, conformément aux instructions transmises.

Article 7 – Frais en cas de rétractation

  1. Si le consommateur exerce son droit de rétractation, les frais directs de retour restent à sa charge.
  2. Pour un enlèvement par notre transporteur spécialisé, les frais de transport s'élèvent à 45 € aux Pays-Bas (65 € en Belgique ; vélos cargos 149 €). Si le consommateur souhaite échanger son vélo contre un autre modèle de notre gamme, les frais d'échange s'élèvent à 25 € (40 € en Belgique).
  3. Si le consommateur dépose directement son vélo dans notre showroom de Rotterdam (Noorderhagen 229), une remise de 50% s'applique sur les frais de retour.
  4. L'entreprise rembourse l'intégralité du montant d'achat (déduction faite des frais de retour applicables) au plus tard dans les 14 jours suivant la notification de rétractation, sous réserve de la réception du vélo en bon état.

Article 8 – Exclusion du droit de rétractation

L'exclusion du droit de rétractation est possible pour les biens confectionnés selon les spécifications précises du consommateur ou nettement personnalisés, à condition que cette exclusion ait été expressément mentionnée avant la commande.

Article 9 – Le prix

  1. Les prix indiqués dans l'offre sont toutes taxes comprises (TTC).
  2. Les vélos d'occasion reconditionnés sont soumis au régime particulier de la marge bénéficiaire (TVA non récupérable, 0% de TVA mentionné sur la facture conformément à la législation européenne sur les biens d'occasion). Les accessoires neufs incluent le taux normal de TVA de 21%.

Article 10 – Conformité et garantie

  1. L'entreprise garantit que les produits sont conformes au contrat, aux spécifications mentionnées et aux exigences légales d'usage.
  2. Tous les vélos reconditionnés Cheapassbikes bénéficient d'une garantie contractuelle standard de 30 jours (1 mois) couvrant toutes les pièces mécaniques et mobiles.
  3. Tout défaut constaté doit être notifié par e-mail ou WhatsApp. Les réparations inférieures à 50 € peuvent être confiées à un vélociste local et remboursées sur présentation de facture. Les réparations supérieures à 50 € sont effectuées gratuitement au sein de notre atelier de Rotterdam.
  4. La garantie est exclue en cas d'usure normale des consommables (pneus, patins de frein), de chute, d'accident, de négligence d'entretien ou d'intervention non autorisée.

Article 11 – Livraison et exécution

  1. L'entreprise apporte le plus grand soin à la réception et à l'expédition des commandes. La livraison est gratuite aux Pays-Bas (Belgique : 19,95 €).
  2. L'adresse de livraison est celle indiquée lors de la commande. Les commandes sont exécutées sous 30 jours au plus tard, généralement en 1 à 2 jours ouvrés.
  3. Si le client a commandé un antivol et n'est pas présent lors du passage du transporteur, le vélo est sécurisé sur place et les clés sont déposées dans la boîte aux lettres.
  4. Le risque d'avarie ou de perte est supporté par l'entreprise jusqu'à la remise effective du bien au consommateur.

Article 12 – Opérations à durée indéterminée ou déterminée

Les contrats d'abonnement ou de longue durée respectent les dispositions d'ordre public relatives au préavis de résiliation maximal d'un mois.

Article 13 – Paiement

  1. Le paiement s'effectue comptant au moment de la commande par les passerelles sécurisées proposées (carte bancaire, Bancontact, iDEAL).
  2. Cheapassbikes exclut de manière éthique les organismes de paiement différé à taux d'intérêt abusifs afin de préserver ses consommateurs.

Article 14 – Procédure de réclamation

  1. Toute réclamation doit être adressée sous 1 mois à compter de la survenance du défaut à info@cheapassbikes.nl.
  2. Les réclamations font l'objet d'une réponse sous 14 jours.
  3. En cas de litige persistant, le consommateur peut faire appel à la médiation gratuite de Stichting WebwinkelKeur (www.webwinkelkeur.nl) ou à la plateforme européenne de règlement en ligne des litiges (ec.europa.eu/consumers/odr).

Article 15 – Litiges

  1. Les contrats conclus sont exclusivement soumis au droit néerlandais, même pour les clients résidant à l'étranger.
  2. La Convention des Nations Unies sur les contrats de vente internationale de marchandises (CISG) est expressément exclue. Les tribunaux compétents de Rotterdam sont seuls habilités.

Article 16 – Dispositions complémentaires ou dérogatoires

Les dispositions dérogatoires ou complémentaires aux présentes conditions ne peuvent porter préjudice aux droits des consommateurs et doivent être établies par écrit sur un support durable.
